The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504, 379/34 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case is that initially three accused persons namely Rajeev Kumar, Sanjeev Kumar and Karu Yadav @ Satish Kumar assaulted the informant. When the maternal-grand-mother of the informant came to rescue then Putush Kumar, petitioner Umesh Yadav came and Umesh Yadav assaulted with lathi and snatched the gold locket.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.25068 of 2016 (2) dt.20-06-2016 petitioner that accusation of assault is omnibus and general. The injury has been found to be superficial and simple in nature. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. The other similarly situated accused persons have been granted bail by the learned court below. Statement to that effect has been made in para-10 of the petition.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Harnaut P.S. Case No. 88 of 2016, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
