The petitioner apprehends his arrest in connection with Saraiya P.S. Case No. 427 of 2021 registered for the offence under Sections 272 and 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Recovery of 3826 litres of liquor has been made from the truck.

In view of the allegations levelled against the petitioner and in view of his criminal antecedent of similar nature, this anticipatory bail application is not maintainable in view of the judgment of the Full Bench of this Court in the case of Ram Binay Yadav Vs. The State of Bihar reported in [2019
