1. Heard learned counsel for the petitioner, Ms. Akansha Verma and learned A.P.P. for the State, Mr. Rabindra Kumar.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 329(4) and 3(5) of the BNS, 2023.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on 15.06.2025 the accused persons including the petitioner entered his house and assaulted him and even assaulted his two brothers causing injury on their head.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that no specific allegation of assault is alleged against any of the
Patna High Court CR. MISC. No.7205 of 2026(3) dt.25-02-2026 2/2 accused persons including the petitioner. It is also submitted that similarly situated co-accused Bhola Ram @ Bhola had approached this Court seeking anticipatory bail by filing Criminal Miscellaneous No. 69707 of 2025 and the same came to be allowed by an order dated 09.10.2025 by a learned Coordinate Bench.
5. Learned A.P.P. for the State opposes the anticipatory bail application of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Sachivalaya P.S. Case No. 129 of 2025 subject to the conditions as laid down under Section 482 (2) of BNSS.
7. Accordingly, the instant anticipatory bail application is allowed.
