The University in the counter affidavit has made statement that the petitioner has been paid arrears under different heads, however, the counter affidavit is silent on the point of arrears of salary for the period January 2006 to July, 2010 and Group Insurance.
Counsel for the petitioner submits that the respondents have in fact not paid salary to the petitioner for the period January 2006 to July, 2010, undeposited PF, part of Group Insurance and Welfare.
Patna High Court CWJC No.8655 of 2016 (3) dt.19-02-2018 2/2 In view of the fact that certain amount has already been paid by the respondent and in para 16 it is stated that the University undertakes to redress the grievance of the petitioner against any amount under any head.
In view of the undertaking made in para 16 of the counter affidavit, the writ application is disposed of with a direction to the University to make necessary calculation of the admissible dues of the petitioner under the head arrears of salary from January 2006 to July, 2010, undeposited PF, part of Group Insurance and Welfare within a maximum period of 60 days from the date of receipt of a copy of this order.
It is needless to state here that in view of the undertaking in para 16 the University is required to ensure payment of the dues after proper calculation within a further period of one months from the date of calculation of the admissible dues.
With the aforesaid, the writ application stands disposed of.
