JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-06-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 47(a) of the Excise Act. From the house of co-accused Deepak Kumar 160.305 litres of foreign liquor were recovered. It is alleged against the petitioner that petitioner being agnate of co-accused Deepak Kumar might be instrumental in storing the foreign liquor.

It is submitted by learned counsel for the petitioner that recovery has admittedly not been made from the possession of the petitioner and the accusation has been levelled only on presumption.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the

No.25023 of 2016 (2) dt.20-06-2016 2/2 petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati in connection with Sherghati P.S. Case No. 187 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
