JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The statement of victim was recorded under section 164 of the Cr.P.C in which she stated that she herself had left her home along with petitioner. The age of victim was assessed by the concerned Magistrate as 16 years but the doctor found her age between 17 to 19 years.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Saharsa in connection with Bihra P.S.Case No. 74 of 2015.
