The petitioner seeks bail in connection with S.T. No. 487 of 2023, arising out of Mairwa P.S. Case No. 34 of 2016 instituted for the offence under Section 302 of the Indian Penal Code.

Prosecution case, in a nutshell, is that petitioner assaulted his wife by means of knife over trivial dispute, due to which she succumbed to injuries.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 06.05.2023. Petitioner bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Learned counsel for the petitioner submits that petitioner is poor labourer. Learned counsel for the petitioner submits that due to ill motive petitioner is dragged in this case. It is lastly submitted that charge in this case is framed. 6.
Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. It is submitted that there is specific allegation of giving knife blow upon the wife is against the petitioner, due to which she died. Post mortem report suggests the cause of death due to shock hemorrhage caused by injuries.

Considering the aforesaid facts and circumstances of the case, there being direct allegation against the petitioner of stabbing his wife by means of knife, this Court is not inclined to grant bail to the petitioner. Prayer for grant of bail to the petitioner is hereby rejected.

The Trial Court is directed to expedite the trial as expeditiously as possible without any undue delay and unnecessary adjournments.
