JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2019 This is an application for grant of anticipatory bail in connection with Kishanganj Mahila P.S. Case No. 50 of 2018, disclosing offences under Sections 376, 306 and 34 of the Indian Penal Code.

Allegation against the petitioner, who is minor, is of committing rape upon the informant and thereafter forcibly administered poison in her mouth.

Submission of learned counsel for the petitioner is that he is a juvenile and aged about 16 years. Further, he has no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case as stated above and also considering

Patna High Court Cr.Misc. No.7826 of 2019(2) dt.13-02-2019 2/2 the age of the petitioner, let petitioner appear before the Juvenile Justice Board for assessment of his age on 05.03.2019. Till then, no coercive steps be taken against the petitioner in connection with Kishanganj Mahila P.S. Case No. 50 of 2018.

With the above observation, this application is disposed of.
