====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 29-04-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 26.07.2022 and is a person with clean antecedent.

The informant alleges that he was robbed by four persons at point of pistol.

The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next submitted that FIR is against unknown and the name of the petitioner transpired in the confessional statement of Kundan

Patna High Court CR. MISC. No.8011 of 2023(2) dt.29-04-2023 2/2 Kumar which has no evidentiary value, it is also submitted that Kundan Kumar has been granted bail by order dated 24-04-2023 in Cr. Misc No. 3025 of 2023 by a learned Coordinate Bench. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Rajgir P.S. Case No. 398 of 2022.
