In this case, the petitioners are seeking anticipatory
Patna High Court Cr.Misc. No.6393 of 2019(2) dt.13-02-2019 2/3 bail in connection with Palasi P.S. Case No.237 of 2015, registered for the offence under Sections 420, 406, 467, 468, 471 and 120(B) of the Indian Penal Code.
Earlier, these petitioners have approached this Court for anticipatory bail in Criminal Miscellaneous No. 20619 of 2017, the same was rejected vide order dated 12.09.2018. Learned counsel for the petitioners submits that the petitioners would deposit 50% of the amount, which is standing over these petitioners on the date of lodging of the F.I.R., within a period of six weeks.
In view of the above statement made at Bar, let the above-named petitioners, be released on provisional bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Palasi P.S. Case no. 237 of 2015, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. This provisional bail is subject to the condition that the petitioners would deposit 50% of the amount, which is standing over these petitioners on the date of lodging of the
Patna High Court Cr.Misc. No.6393 of 2019(2) dt.13-02-2019 3/3 F.I.R., within a period of six weeks from today. In failure to make payment of aforeaid amount, as has been mentioned hereinabove, this order will be treated to have withdrawn. If these petitioners deposit the aforesaid amount within the period as mentioned hereinabove, in such circumstance, their provisional bail will be confirmed.
