The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 504, 307, 379/34 of the Indian Penal Code.

The prosecution case is that on protest being made for encroaching public road co-accused Lalan Singh abused the informant, when assault was made by Lalan Singh, petitioner no. 4 Mohan Singh @ Mohan Kumar, petitioner no. 3 Ramod Singh @ Ramodh Singh and petitioner no. 2 Manjay Singh. Petitioner no. 2 Manjay Singh snatched gold chain from the informant.

Patna High Court Cr.Misc. No.25083 of 2016 (2) dt.20-06-2016 It is submitted by the learned counsel for the petitioners that in the background of bona fide dispute with regard to the road accusation has been levelled. Only one injury has been found on the head of the informant, caused by sharp cutting weapon, simple in nature. Case from the petitioners' side was filed on 04.08.2016 when the present First Information Report was registered on 18.11.2015. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.

Considering the accusation being not corroborated by the medical opinion and the case lodged by the petitioners' side at earlier point of time, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran in connection with Dhaka P.S. Case No. 266 of 2015, subject to conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) P.K./- U T
