The petitioner seeks bail in Sessions Trial No. 242 of 2014 arising out of Pothia P.S. Case No. 277 of 2013 registered under Section 366-A read with 34 of the Indian Penal Code. The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 15.09.2015 passed in Cr. Misc. No. 30473 of 2014.
From perusal of the impugned order dated 21.07.2015 passed by the learned Sessions Judge, Kishanganj, it would appear that the trial is in progress and altogether four
Patna High Court Cr.Misc. No.38268 of 2015 (2) dt.19-08-2015 2 / 2 prosecution witnesses have already been examined. The learned Sessions Judge has observed that the trial of the case is proceeding on day-to-day basis.
Regard being had to the advanced stage of the trial, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected.
