JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-10-2022 In pursuance to the earlier order of this Court dated 20.09.2022, a counter affidavit has been filed by the Circle Officer, Dinara, Rohtas, wherein it has been stated that an encroachment proceeding bearing Encroachment Case No. 24 of 2022-23, has been initiated by the Circle Officer, Dinara, Rohtas, and it is submitted that the same shall be concluded forthwith.
The learned counsel for the petitioner submits that direction be issued to the Circle Officer, Dinara, Rohtas, to
Patna High Court CWJC No.2700 of 2020(3) dt.11-10-2022 2/2 conclude the proceedings of the aforesaid Encroachment Case expeditiously.
Having regard to the facts and circumstances, I deem it fit and proper to dispose off the present writ petition with a direction to the Circle Officer, Dinara, Rohtas, to conclude the proceedings of the aforesaid Encroachment Case No. 24 of 2022-23, by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, within a period of 12 weeks from today, in accordance with law and after hearing the affected parties.
