The petitioner is languishing in jail since 17.06.2015 in a case instituted under Sections 304(B)/34 of the Indian Penal Code.
As per allegation, it is a case of murder of informant's married daughter who is aged about 18 years by the accused persons due to non-fulfilment of demand of dowry. It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.06.2015. Petitioner has got no criminal antecedent. Chargesheet has been submitted in the case for an offence under Section 302 Indian Penal Code. It would appear from paras 28 and 34 of the case diary that the petitioner
Patna High Court Cr.Misc. No.38113 of 2015 (3) dt.07-10-2015 was working at Nagaland after the marriage and he was not present there at the time of occurrence.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances that the petitioner was not present at the time of occurrence, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction learned CJM, Sitamarhi in connection with Runnisaidpur P.S.Case No.326 of 2013.
