The petitioner prays for grant of anticipatory bail in Nadi P.S. Case No. 184/2020 registered for the offence punishable under Sections 147/148/149/341/323/307/302/504/ 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner is alleged to have shot dead the deceased along with his friends. Two persons were caught by the mob out of them one died due to the assault by mob and the second one survived. During investigation, it has come that the deceased has sustained two bullet injuries and the petitioner is the author of one of the bullet injuries.
In a case under Section 302 of the Indian Penal Code when the petitioner is having criminal antecedent and is an
Patna High Court CR. MISC. No.16970 of 2021(7) dt.04-02-2022 2/2 active participant in the murder of the deceased, he cannot be granted anticipatory bail.
Under the facts and circumstances, this is not a fit case for grant of anticipatory bail.
It is, accordingly, dismissed.
