The petitioner apprehends his arrest in a case registered for the offences punishable under Section 420 and ther allied sections of the Indian Penal Code and sections 30(a), 32, 36 and 41of the Bihar Prohibition and Excise Act, 2016. Total 874.44 litres of foreign liquor has been recovered from different vehicles.

It is submitted that petitioner has falsely been implicated in this case. Name of petitioner transpired in this case on the basis of confessional statement of co-accused. Nothing has been recovered from conscious possession of this petitioner. Petitioner is neither driver nor owner of vehicles in question. Petitioner claims clean antecedent.

No.13533 of 2023(3) dt.23-06-2023 2/2 Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise-01, Samastipur in connection with Musrigharari P.S. Case No. 157 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
