The petitioner seeks bail in Haveli Kharagpur P.S. Case no. 46/2007, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.

The informant alleged that Ravi Shankar Singh @ Bhulan Singh came and took his brother for walk. The informant later on came to know that his brother (deceased) was smoking ganja with the accused persons Ravi Shankar Singh, Sachidanand Singh, Madhav Kumar Singh and Jogi Paswan, but he did not return. Later on the dead body of his brother was found in a well. It is submitted that there is no eye-witness of the occurrence. The police after investigation submitted final form finding the allegation against the petitioner false. Similarly

Patna High Court Cr.Misc. No.39518 of 2015 (2) dt.07-09-2015 2/2 situated co-accused Ravi Shankar Singh and Madhav Kumar Singh have already been enlarged on bail.

Taking into consideration the facts aforesaid and the fact that the case of the petitioner stands on the same footing, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge II, Munger, in connection with Haveli Kharagpur P.S. Case No. 46/2007.
