JUSTICE SUDHIR SINGH ORAL ORDER 18-05-2022 Heard learned counsel for the petitioner and the State. Learned counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.
The petitioner is apprehending his arrest in Lakhisarai P.S. Case No. 167 of 2020 registered under Sections 302, 120B/34 of the Indian Penal Code and Sections-25(1-b)a/26(i),27 of the Arms Act.
Prosecution case is that the informant's father has been shot at by named accused persons who came on Pulsar motorcycle.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The
Patna High Court CR. MISC. No.16671 of 2021(3) dt.18-05-2022 2/2 petitioner has been made accused in the present case due to village politics. There is no motive alleged against the petitioner for committing the alleged offence.
On behalf of the State, it is submitted that the petitioner is named in the FIR. He is one of the assailants as per the FIR. Considering the fact that the petitioner is one of the assailants, I am not inclined to grant anticipatory bail to the petitioner.
Accordingly, prayer for anticipatory bail of the petitioner is rejected.
If the petitioner surrenders in the court below and seeks regular bail, the same shall be considered on its own merit without being prejudice by this order.
