1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307, 504, 506 and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioners have antecedent of one case and the informant alleges that petitioners assaulted his father by tangi and lathi respectively causing injury on head, further the occurrence took place as the petitioners objected grazing of land by the cattle of the informant.

4. Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.23172 of 2024(2) dt.22-07-2024 2/3 since cattle of the informant was grazing their field, as such, an altercation took place in which both sides assaulted each other. It is also submitted that the blow was not repeated and the order impugned inadvertently records that the injury suffered by the father of the informant is grievous in nature.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Chandramandi P.S. Case No. 195 of 2023 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

However, the learned Trial Court before accepting the bail bonds of the petitioners shall verify from the injury report whether the injury suffered by the father of the informant is grievous or not and in the event if it is found that the injury suffered by the father of the informant is grievous in nature in

8. Accordingly, the instant anticipatory bail application stands allowed.
