JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-06-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Dehri ( Rohtas) SC/ST Police Station Case No. 39 of 2015 registered for the offences punishable under Sections 376, 504, 506/34 of the Indian Penal Code.

One of the F.I.R named accused Ravi Ranjan Singh @ Babuan Singh used to tease the informant and, subsequently, established physical relation with the informant by putting her under threat and also called her at Bhaluni Dham Temple for solemnization of marriage but when the informant went there, the aforesaid Ravi Ranjan Singh and his two friends disclosed that family members of aforesaid co-accused Ravi Ranjan Singh were not ready for the aforesaid marriage as the informant belongs to

Patna High Court Cr.Misc. No.24912 of 2016 (2) dt.16-06-2016 2/2 'Nichi Jati'. The informant went to make complaint to the petitioners, who happen to be family members of co-accused Ravi Ranjan Singh, but, allegedly they abused calling her as Nichi Jati. Contention on behalf of the petitioners is that the provisions of SC/ST (Prevention of Atrocities) Act are not applicable against the petitioners and so far as allegation of rape is concerned, the same is against the co-accused Ravi Ranjan Singh and, therefore, in the aforesaid circumstance, the anticipatory bail of the petitioners is maintainable.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Rohtas in Dehri ( Rohtas) SC/ST Police Station Case No. 39 of 2015, subject to condition as laid down under Section 438(2) of the Cr.P.C.
