2. The present writ petition has been filed seeking direction to the respondents to conduct proper investigation in Parihar P.S. Case No. 229 of 2024 submitting that the Deputy Superintendent of Police, Sitamarhi has filed closure report in this case though the accused persons killed the husband of the petitioner.

3. On the basis of written report given to the police

Patna High Court CR. WJC No.194 of 2025 dt.24-11-2025 2/3 by the petitioner, Parihar P.S. Case No. 229 of 2024 was instituted wherein it has been alleged that the FIR named accused persons assaulted her husband and when he was taken to hospital for treatment, he succumbed to his injuries.

A counter affidavit has been filed on behalf of State respondents wherein it has been specifically mentioned that in the background of land dispute, some scuffle took place between the parties and during scuffle, the husband of the informant fell down and it was the FIR named accused Md. Kayum, who called the police on dialing 112. The post mortem report has been annexed with the counter affidavit and it has been specifically mentioned in the post morten report that there was no evidence of any pressure over nose, mouth, neck or chest. It has further been mentioned therein that rupture of heart was caused due to heart disease and death was due to heart disease. However, viscera has been preserved for histopathological examination. Thereafter, in his supervision, the Superintendent of Police, Sitamarhi directed the investigating officer to deeply investigate the matter against the FIR named accused persons while recording that the involvement of the some of the FIR named accused persons was not apparent.

5. In the light of aforesaid discussion, I do not think

Patna High Court CR. WJC No.194 of 2025 dt.24-11-2025 3/3 the investigation has not been proper as alleged by the petitioner and considering the post mortem report, it seems petitioner has filed a completely false and frivolous petition before this Court.
