The petitioner is in custody since 20.10.2013 in connection with Industrial Area Hajipur P.S. Case No. 461 of 2007 registered for the offences punishable under Sections 363, 365, 364, 120B of the Indian Penal Code.
It is submitted on behalf of the petitioner that originally the father of the victim boy filed a case stating that his son Shailendra Kumar had gone for making papers of old Yamaha Motorcycle which he had purchased second hand. It is further submitted that in the said statement there is no mention of his name. However, later on it has been stated by the father of the victim boy that his other son Dipu told him that on 19.08.2007, the victim boy was seen talking to Raja and Vishwajit (petitioner) on mobile phone near the temple situated at Ganga village colony and it was only thereafter, Shailendra Kumar proceeded for preparing the papers of motorcycle. Patna High Court Cr.Misc. No.38139 of 2014 (4) dt.09-01-2015 2/2 that apart from this fact/ suspicion raised by other son of the informant, there is no other cogent material on record so as to implicate him in connection with the present case. Learned counsel further submits that on 27.08.2007 i.e., after lapse of nine days of the occurrence, the informant lodged FIR only on suspicion.
Considering the submissions and also the period of custody being almost a year, let the petitioner, Vishwajeet Kr. @ Vishwajeet Kumar Singh be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Industrial Area Hajipur P.S. Case No. 461 of 2007.
