1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 352, 351(2), 109 and 3(5) of BNS read with Section 27 of the Arms Act and Section 37 of the Bihar Excise Act.
3. Learned counsel for the petitioners submits that the name of the father of the petitioner no. 2 is Awadhesh Singh @ Awadh Singh, but inadvertently the same was deleted and Gauri Shankar Singh was recorded based on objection made by the Stamp Reporter. It is next submitted that a supplementary
Patna High Court CR. MISC. No.8171 of 2025(2) dt.06-03-2025 2/3 affidavit to that effect has been filed.

Learned counsel for the petitioners further submits that petitioners are persons with clean antecedent and the informant alleges that on 29.11.2024 at about 21.40 PM while he was on patrolling duty, he received an information that two families are scuffling at village Beli, accordingly the informant reached the place of occurrence along with other police personnel when he saw some accused carrying arms and abusing each other, but on seeing the police force, they fled from the place of occurrence but one person was apprehended namely Rajesh Kumar Singh who disclosed that Mithun Kumar Singh abused and fired at him on account of political rivalry, but missed, further on hearing the sound of gunshot, people started gathering when Mithun fled away thereafter again at 21:30 PM Mithun along with his brother came at his door carrying arms and abused and they were drunk.

The learned counsel for the petitioners submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that a bald allegation has been levelled by Raju before the SHO, Feshar P.S. when he was apprehended, that Mithun fired at him on account of political rivalry, but then he was not injured. It is also submitted that he has tried to implicate the

6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
7. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Feshar/ Phesar P.S. Case No. 136 of 2024 subject to the conditions as laid down under Section 482(2) of the BNSS.
8. The supplementary affidavit filed on behalf of the petitioners is taken on record.
