JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 24-04-2019 After some argument learned counsel senior counsel representing the petitioner submits that the writ application may be disposed of with liberty to the petitioner to prefer statutory appeal before the District Magistrate, Madhubani within a period of 30 days from today.

It is further submitted that the petitioner should also be given liberty to raise all such pleas which may be available to the petitioner before the appellate authority. Learned counsel for the State has no objection to the submission on behalf of the petitioner.

In the given facts and circumstances of the case, this

Patna High Court CWJC No.2203 of 2019(2) dt.24-04-2019 2/2 writ application is being disposed of with liberty to the petitioner to file statutory appeal before the District Magistrate, Madhubani within a period of 30 days from today. It goes without saying that while filing the statutory appeal petitioner will have liberty to raise all such pleas which are available to the petitioner and the appellate authority will be obliged to consider each and every plea of the petitioner in accordance with law. If such appeal is preferred within the prescribed period, the appellate authority shall hear and dispose of the same within a period of 60 days from the date of filing of the appeal by a reasoned order.
