Learned counsel for the State submits that the petitioner has got an alternative remedy in terms of Rule 32 of the Bihar Targeted PDS (Control) Order, 2016, but instead of seeking his remedy under the provisions of the Control Order, 2016 petitioner has directly moved this court under Article 226 of the Constitution of India.

In the given facts and circumstances of the case, this court finds that the writ application is not fit to be entertained as the petitioner has got an alternative statutory remedy which he would be at liberty to avail. In case, such a remedy is applied for

Patna High Court CWJC No.2055 of 2019(2) dt.17-04-2019 2/2 and a question of limitation arises, the appellate authority shall consider the same keeping in mind that the petitioner was pursuing his remedy before this court.
