The petitioner has prayed for regular bail in a case registered for the offence punishable under section 394/120(B) of the Indian Penal Code.

As per allegation in the FIR, informant is bank manager and on 7.3.2022 while he was working with his two staffs, four miscreants entered into the Bank. Two accused were carrying arms and told the customers to raise their hands. Thereafter, two of them went to cash counter and taken away an amount of Rs. 12,96,469/- and ran away by motorbikes. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Neither the petitioner is named in the FIR not put on TIP. Petitioner was

Patna High Court CR. MISC. No.7019 of 2023(3) dt.05-07-2023 2/2 arrested on 13.3.2022 in connection with Ara Town PS Case No. 232 of 2022 and remanded in this case on 29.3.2022. Similarly situated other accused person has already been enlarged on bail by another coordinate Bench of this Court vide order dated 23.12.2022 passed in Cr. Misc. No. 53856 of 2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhojpur in connection with Udwant Nagar P.S. Case No. 106 of 2022.
