JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-02-2019 This is an application for grant of anticipatory bail in connection with Bithan P.S. Case No. 168 of 2017, disclosing offences under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 30(D), 38(1), 38(2) of the Bihar Prohibition and Excise Act.

Allegation is of recovery of 30 liters liquor from the house of the petitioners.

Submission of learned counsel for the petitioners is that the recovery is from the joint house Lalit Kumar and the petitioners are wife and Bhabho of him and nothing has been recovered from their conscious possession. Further, they are ladies and having no criminal antecedents.

Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act Cum A.D.J. 3rd, Samastipur, in connection with Bithan P.S. Case No. 168 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
