JUSTICE SHIVAJI PANDEY ORAL ORDER 27-01-2016 Heard the counsel for the petitioner and the counsel for the State.
This Court has called for status report of the case. As per the status report, five chargesheet witnesses have been examined and there is a likelihood of disposal of the criminal case. The counsel for the petitioner submits that all the prosecution witnesses have been examined. It appears that the police recovered the looted amount from the possession of the petitioner and also from Lalo @ Lalu yadav @ Lalo Yadav @ Lalu. The counsel for the petitioner submits that the petitioner is in jail since 12.10.2014. In such view of the matter, the petitioner is directed to be released on bail looking into the custody of the petitioner
Patna High Court Cr.Misc. No.39171 of 2015 (4) dt.27-01-2016 2/2 on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with K. Nagar P.S. Case No. 562 of 2014, subject to the conditions that:- (i) one of the bailors will be a close relative, either wife or father or mother of the petitioner;
(ii) if the petitioner is found involved in similar type of case in future, the prosecution will be at liberty to file application for cancellation of bail and the court below will pass necessary order including cancellation of bail; and (iii) the petitioner would co-operate in the proceeding and in the event of being absent on two consecutive dates without reasonable explanation, the court below will be at liberty to pass appropriate order including cancellation of bail bonds of the petitioner.
The court below is directed to conclude the trial within two months from the date of receipt of a copy of this order. (Shivaji Pandey, J) Dilip/- U T
