The petitioners seek bail in anticipation of their arrest in connection with Jehanabad P. S. Case No. 548 of 2018, dated 13.07.2018, instituted for the offences under Sections 147, 148, 149, 323, 341, 307, 504 and 506 of the Indian Penal Code.
Patna High Court CR. MISC. No.14332 of 2020(4) dt.25-10-2021 2/3 The petitioners are alleged to have assaulted the members of the prosecution party for their not having acceded to the demand of withdrawing a murder case in which the petitioners were made accused earlier. Though the accusation against the petitioners is general and omnibus but two persons are said to have received simple injuries.
Regard being had to the fact that the petitioners are also accused in a murder case about which reference has been made in the F.I.R., I am not inclined to grant anticipatory bail to them.
The prayer for anticipatory bail is, hereby, rejected.
However, if the petitioners surrender before the court below and seek bail, the court below shall consider the fact that the injuries suffered by the two victims are simple in nature and that there could be a possibility of false implication of the petitioners and shall pass orders in accordance with law, without being prejudiced by the
