JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 21-06-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Patrakar Nagar Police Station Case No. 171 of 2014, disclosing offences under Sections 420, 406/34 of the Indian Penal Code.

It is alleged that the petitioner induced the informant to pay him certain amount for ensuring his job in a good establishment. Allegedly, the informant paid such amount, some of which was deposited in the account of the petitioner.

Learned Counsel for the petitioner, denying the allegation made against him, has submitted that it is true

Patna High Court Cr.Misc. No.24650 of 2016 (3) dt.21-06-2016 2/3 that the petitioner had taken a total sum of Rs. 30,000/- from the informant, but no assurance was given for the purpose of arranging a job for the informant. He has submitted that out of the said Rs. 30,000/-, the petitioner has already paid Rs. 5000/- to the informant and he is ready to pay a sum of Rs. 25,000/- to the informant within a period of one month from today.

Considering the submissions, as above, this application is allowed.

Let the petitioner, Nitesh Kumar @ Nitesh Kumar Verma, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Krishna Gopal, Judicial Magistrate, 1st Class, Patna/successor Court, in connection with Patrakar Nagar Police Station Case No. 171 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be
