JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-01-2015 Petitioners are languishing in custody since 25.01.2014 in a case registered for the offences punishable under Sections 376/120B of the I.P.C.
It is alleged that petitioner Pano Devi took the informant for getting the death certificate. On way back the petitioner Jamshed ravished the informant when the
Patna High Court Cr.Misc. No.23576 of 2014 (4) dt.12-01-2015 commission of rape was facilitated by petitioner Pano Devi. It is submitted by learned counsel for the petitioners that the victim in her 164 Cr.P.C statement has not named the petitioner Jamshed. The medical opinion assessed the age of the victim between 15-16 years and the doctor has not found any evidence with regard to the sexual assault. Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 51 of 2014.
