The petitioner is languishing in custody for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Petitioner is in custody since 08.08.2020. Allegation is that liquor was recovered while was being thrown from a motorcycle. The petitioner has got criminal antecedents of identical nature.

Considering lack of material in this case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bairiya P.S. Case No. 363 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

Patna High Court CR. MISC. No.17020 of 2021(3) dt.04-10-2021 2/2 (b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) If the court below would come to the notice that the petitioner is involved in the identical case that would be a ground for cancellation of bail in this case by the court below itself.
