2. The petitioner apprehends his arrest in connection with Simri Bakhtiyarpur P.S. Case No. 590 of 2023 registered for offences under Sections 448, 341, 323, 325, 307, 379, 504, 34 of the Indian Penal Code.
3. The petitioner is said to have assaulted one Md. Saifan who has sustained injury in the parietal reason.
4. Considering the facts and circumstances of the case, I do not find it to be a fit case for anticipatory bail.
5. The application for anticipatory bail is, accordingly, dismissed.
6. However, if the petitioner surrenders in the court
Patna High Court CR. MISC. No.6927 of 2025(2) dt.21-02-2025 2/2 below within a period of four weeks from today and seeks regular bail, the same shall be considered by the District Court without being prejudiced to the fact that the anticipatory bail application of the petitioner has been rejected by this Court.
7. The Court below will also consider the fact that the co-accused persons namely Md. Niyaz @ Niyaz Ali and Md. Rabbani @ Md. Gulam Rabbani have been granted regular bail by this Court vide order dated 23.10.2024 passed in Cr. Misc. No. 75124 of 2024.
