The petitioners being the son and the daughter-in-law are apprehending their arrest in a case registered for the offence punishable under sections 341, 323, 452, 380, 420, 406, 504, 506/34 of the Indian Penal Code.
Prosecution case is that on 13.1.2016 the informant had gone to PGIMS, Chandigarh for treatment of her husband and her son and daughter-in-law were at home, who after breaking the locks of the room took away ornaments and sale deeds of land. On 7.3.2016 the informant came and found that new lock was put in the room and on query the petitioners started abusing. The petitioners prepared forged papers and executed sale deeds. It is submitted by the learned counsel for the petitioners
Patna High Court Cr.Misc. No.25185 of 2016 (2) dt.21-06-2016 that the petitioners have executed the sale deed from their share of property. The basic dispute is with regard to sale deed of the property executed by the father of petitioner no.1 in favour of his daughter Ranjana Thakur. On 16.3.2016 the father of the petitioner no.1 further executed sale deed in favour of one Smt. Prem Sinha.
Considering the nature of accusation in the background of share dispute, let the petitioners, abovenamed, be released on provisional bail for a period of four months, in the event of their arrest or surrender before the court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga in Moro P.S.Case No. 11/2016, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
The provisional bail of the petitioners will be confirmed by the learned court below after taking report from the concerned police station that the petitioners have executed the sale deed from their share.
