The petitioner seeks bail in Begusarai (Town) P.S. Case No. 856 of 2013, registered for the offences punishable under different Sections of the Arms Act.
Two persons namely Ranjit Kumar Mahto @ Shukla and the petitioner Mantun Yadav were apprehended by the police and on search from the possession of the petitioner Mantun Yadav one loaded country made pistol was recovered. The petitioner is in jail since 18.12.2013.
A report was called for from the Learned SubDivisional Judicial Magistrate, Begusarai reported vide Letter No. 14 dated 02.03.2015 that the court of the Learned Sub-Divisional Judicial Magistrate, Begusarai was vacant and now the Learned
Patna High Court Cr.Misc. No.28660 of 2014 (6) dt.16-04-2015 2/2 Sub-Divisional Judicial Magistrate, Begusarai has joined and it is reported that the trial would be concluded within four months. The petitioner has already remained in jail for about 1 1⁄2 years. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai (Town) P.S. Case No. 856 of 2013. Subject to the condition that the petitioner shall physically appear on each and every date and if the petitioner does not appear even on a single day the court below shall cancel the bail bond of the petitioner.
