2. The petitioner has preferred this application for grant of regular bail in connection with Rafiganj P.S. Case No. 216 of 2021 dated 20.07.2021 registered for the offences punishable u/ss 147, 148, 149, 341, 323, 353, 307, 379 and 411 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, on 19.07.2021, the F.I.R. named accused persons including the petitioner attacked the police party while their tractors (three tractors) loaded with illegal sand was seized by police. It is further alleged that the accused persons obstructed and prevented the

No.7567 of 2025(2) dt.08-04-2025 2/3 police from discharging their public duties and even opened fire on them in order to take the seized tractors from the possession of police. However, two miscreants namely, Dablu Singh and Bittu Singh were nabbed by police. It is further alleged that three tractors were also seized.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is no specific allegation against the petitioner rather the allegation is general and omnibus in nature. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged offence. The petitioner has seven criminal antecedents in which he is on bail as stated in para 3 of the bail petition. The petitioner is in custody since 18.12.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Aurangabad in connection with Rafiganj
