The petitioner Ashok Sah seeks bail in Majorganj P.S. Case No. 70 of 2014, registered for the offences punishable under Sections 307, 498(A) and some other Sections of the Indian Penal Code.
The wife of the petitioner made allegation that her husband demanded Rs. 2 lacs and due to non-fulfillment the alleged demand, her husband assaulted her and also made an attempt to kill her.
Learned counsel for the petitioner submits that police after investigation submitted charge sheet under Section 498A of the Indian Penal Code. The allegation under Section 307 of the Indian Penal Code was found false. The petitioner is in jail since 29.05.2014.
Patna High Court Cr.Misc. No.37361 of 2014 (2) dt.24-12-2014 Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that the petitioner has remained in jail for about seven months, he, namely, Ashok Sah is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Majorganj P.S. Case No. 70 of 2014.
