The petitioner is in custody in a case registered under Sections 304(B)/34 of the Indian Penal Code. The allegation against the petitioner and other coaccused is of killing the sister of the informant for non fulfilment of additional demand of dowry.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. He is in custody since 5.5.2015.Charge sheet has been submitted in this case.There is no allegation of tampering with the evidence against the petitioner. The petitioner is the father-in-law of the deceased. Independent witnesses, who are examined in course of

Patna High Court Cr.Misc. No.39499 of 2015 (3) dt.12-10-2015 2/2 investigation, whose statements are in pars 38, 44,46,45 and 45 of the case diary, indicate that the brother of the deceased had come and abused the deceased for her unusual behaviour and for the said reason she had committed suicide. There is no specific allegation against the petitioner.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M.,Buxar in Bagengola P.S.Case No. 16 of 2015.
