JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-04-2019 The petitioner apprehends his arrest in connection with Complaint Case No. 973 of 2017 registered under Sections 323, 379, 380 and 498A of the Indian penal Code.
Allegation against the petitioner is of subjecting the informant to cruelty and harassment with respect to demand. Submission of learned counsel for the petitioner is that whole allegation is false and concocted and the conduct of the O.P.No. 2 shall appear from the fact that she had filed a title suit against the petitioner for partition of property, however, he is ready to keep O.P.No. 2 with dignity and care. Heard learned APP also.
Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed,
Patna High Court CR. MISC. No.6774 of 2019(4) dt.03-04-2019 2/2 surrender before the court below on 18.04.2019 and on that day O.P.No. 2 shall also remain present in the court and if any petition is filed by the petitioner that he is ready to keep her with dignity and care and is ready to take her from the court itself, he will be released on provisional bail for a period of six months to its own satisfaction and during that period, conduct of both parties will be watched by the court below and after six months if the court below satisfies to the conduct of the petitioner, his provisional bail shall be confirmed; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
