JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 363, 366-A of the Indian Penal Code.

As per the prosecution case, petitioner kidnapped 15 years old informant's daughter for the purpose of marriage. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on suspicion as he happens to be father of the main accused Ravi Shankar Rai who is alleged to have kidnapped informant's daughter. As a matter of fact, informant's daughter and the petitioner's son had left their house out of their sweet will. Besides this, informant's daughter had sent an application to the Inspector General of Police, Tirhut range, Muzaffarpur, stating that her father had settled her marriage with an aged person so she left home with her friend Ravi Shankar Rai and married him and they are leading happy conjugal life. Petitioner claims clean antecedent. Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with
