2. The petitioner apprehends his arrest in connection with Wazirganj P.S. Case No. 595 of 2023, registered for the offences punishable under Sections 379, 414, 420 of the Indian Penal Code.

3. As per allegation, the informant Manoj Kumar Sinha who is ASI of Wazirganj Police Station proceeded to vehicle checking regarding illegal mining of sand. Further, a person riding a motorcycle was stopped and on enquiry, he did not produce any valid documents. He disclosed his name Rahul Kumar and further narrated that he brought the motorcycle from the petitioner and he was riding the motorcycle after tampering the number plate.

4. Learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent and he has falsely been

Co-accused Rahul Kumar admitted his guilt by stating that he was using the recovered motorcycle after manipulation of the number plate and in his confessional statement the name of the petitioner was figured. Nothing incriminating was recovered from the possession of the petitioner.

5. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in connection with Wazirganj P.S. Case No. 595 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C.
