JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Admittedly the alleged occurrence took place in between 08.11.2005 to 12.11.2005 and the first information report of the present case was registered when one Chuchun Singh@ Fighter Singh was arrested by the police and the said accused made his confessional statement disclosing this fact that at the direction of the petitioner he and other accused killed the deceased of the present case.

Learned counsel for the petitioner submits that except the aforesaid material there is nothing against the petitioner. No doubt, petitioner is veteran criminal having near about 17 cases in his credit but admittedly, except the confessional

Patna High Court Cr.Misc. No.33794 of 2014 (5) dt.16-01-2015 2/2 statement of Chuchun Singh@ Fighter Singh in connection with other cases there appears to be nothing against the petitioner. Moreover, the co-accused Chuchun Singh @ fighter Singh has already been granted to the privilege of bail by a co-ordinate Bench of this Court vide order dated 19.04.2007 passed in Cr. Misc. No. 18656 of 2007 which has been pleaded at para -15 to this petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sheikhpura in connection with Barbigha P.S.Case No. 94 of 2006.
