2. The petitioner has renewed his prayer for anticipatory bail in connection with Kahalgaon P.S. Case No. 170 of 2019, having earlier been rejected by order dated 21.10.2019 in Cr. Misc. No. 63467 of 2019 for the alleged offences under Sections 323, 341, 307 and 379/34 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that the bail application was earlier rejected, observing that the injury report of Sudha Devi of the informant's side showed that she had sustained grievous injury on her head, which possibly emanated from the order of the learned Sessions Judge. He refers to the injury report and the supplementary injury report
Patna High Court CR. MISC. No.17022 of 2021(2) dt.04-08-2021 2/2 (Annexure-3), which disclose that as a matter of fact the injury was sustained on the clavicle and there is no injury on the head of Sudha Devi. It is submitted that the petitioner is a lady and is a Gotia of the informant and claims clean antecedents.
4. Learned APP appears and has been heard.
5. Be that as it may, in the event of petitioner's arrest or surrender before court below within six weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur in connection with Kahalgaon P.S. Case No. 170 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P.C., if she is not otherwise required in any other case.
