The prayer for bail of the petitioner was earlier rejected vide order dated 09.07.2018 passed in Cr. Misc. No. 35207 of 2018.

The petitioner has renewed his prayer for bail on the ground that he has remained in custody since 06.02.2018 and there has not been any substantial progress in the trial.

A report about the stage of the case has been asked for from the court below, which report has been received and has kept at flag-A.

Learned counsel for the petitioner has further drawn the attention of this Court to the fact that one of the other co-accused persons has been granted bail in this case by a Coordinate Bench of this Court.

Considering the accusation against the petitioner of having made attempts to rape a girl and when this could not be accomplished, he is alleged to have assaulted the father of the girl along with others leading to his death, I am not inclined to grant bail to the petitioner notwithstanding the period spent in custody.

The prayer for bail is rejected.

It is expected that the trial proceeding shall continue without delay and would be concluded within a reasonable period of time.
