The petitioner seeks bail in connection with Saraiya P.S. Case No.74 of 2023 (Sessions Trial No.914 of 2023) registered for the offence punishable under Sections 302/120(B)/34 of the Indian Penal Code.

The petitioner is suspected to have participated in the killing of the deceased.

The petitioner is in custody since 07.06.2023 and he has clean antecedent.

Learned counsel for the petitioner submits that there is no evidence direct or indirect against the petitioner. He further submits that similarly situated co-accused Aniket Kumar has been granted bail by this Court vide order dated

Patna High Court CR. MISC. No.8809 of 2024(2) dt.22-02-2024 2/2 17.02.2024 passed in Criminal Miscellaneous No.6141 of 2024. 6.

Considering the period of custody of the petitioner and also the fact that co-accused Aniket Kumar has been granted bail by this Court, this application is allowed. 7.

Let the petitioner, above named, be released on bail after framing of charge on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, VIII, Muzaffarpur, in connection with Saraiya P.S. Case No. 74 of 2003 (Sessions Trial No.914 of 2023).
