This application for grant of anticipatory bail arises out of Phulwarisharif (Janipur) P.S. Case No. 399/2015, disclosing offences under Sections 304B, 302, 201/34 of the Indian Penal Code.
Petitioner No.1 is the younger brother of the deceased. Petitioner Nos. 2 and 3 are the wives of the brothers of the husband of the deceased. The deceased was married with Pramod Kumar fourteen years ago as per the First Information Report. Learned counsel for the petitioners has submitted that no offence under Section 302 of the Indian Penal Code is made out against these petitioners. He has further submitted that similarly
Patna High Court Cr.Misc. No.24781 of 2016 (3) dt.22-06-2016 circumstanced co-accused Sanjay Rai alias Sanjay Kumar, who is elder brother of the deceased, has been granted anticipatory bail by this Court vide order dated 12.05.2016 passed in Cr. Misc. No. 20418 of 2016; certified copy of the said order has been produced before me. Let the same be kept on record.
Considering the submissions as above, this application is allowed.
Let the petitioners above named in the event of their arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Patna in Phulwarisharif (Janipur) P.S. Case No. 399 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
