The petitioners are apprehending their arrest in connection with Hasanpur P.S.Case No.105 of 2018, registered for offences punishable under Sections 147, 148, 149, 341, 323, 325, 307, 379, 427 of the Indian Penal Code. Allegation against the petitioners is of assault to the informant and several other persons and the specific allegation is against Raj Kuar Kamtee and Baijnath Kamtee. Submission of the learned counsel for the petitioners is that no specific allegation has been attributed against these

Patna High Court CR. MISC. No.6633 of 2019(4) dt.06-05-2019 2/2 petitioners and there is case and counter case between the parties and Raj Kuar Kamtee and Baijnath Kamtee have been granted bail by the learned lower court.

Heard learned A.P.P. , who has opposed the prayer for bail on the ground that five persons have received injuries and the opinion about several injuries have been kept reserved. . Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-IIIrd, Rosera, District Samastipur in connection with Hasanpur P.S.Case No.105 of 2018 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid direction, this application is allowed.
