2. The petitioner apprehends his arrest in connection with Simri Bakhtiarpur P.S. Case No. 256 of 2025 registered for the offence under Sections 64(1), 3(5) of B.N.S.

3. As per the prosecution case, petitioner is alleged to have made relationship with the informant on the pretext of marriage

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in this case. It is next submitted that informant is a married woman and she very well knew that she cannot enter into matrimonial relationship without obtaining divorce

Patna High Court CR. MISC. No.5975 of 2026(3) dt.24-02-2026 2/2 from her first husband. Petitioner has clean antecedent.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the concerned Court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saharsa/ concerned Court below in connection with Bakhtiarpur P.S. Case No. 256 of 2025, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482 of the BNSS.
