The petitioner seeks bail in connection with Jehanabad P.S. Case No. 314 of 2015 registered for the offence punishable under Sections 147, 148, 149, 333, 121, 307, 120B, 364, 224, 225, 302 of the Indian Penal Code, Section 27 of the Arms Act and Section 17 of Criminal Law Amendment Act. This is third attempt on behalf of the petitioner whose prayer of bail was earlier rejected twice vide order dated 28.02.2013 and 13.08.2014 passed in Cr. Misc. No. 41163 of 2012 and 15604 of 2014 respectively.
It is evident from the report of the trial court that out of 17 witnesses, 7 witnesses have been examined. Doctor and
Patna High Court Cr.Misc. No.35616 of 2015 (3) dt.24-11-2015 Investigating Officer have also not been examined. Considering the seriousness of the offence and finding no good ground for reconsideration of prayer of bail, again the prayer of bail of the petitioner stands rejected. However, the trial court is directed to expedite the trial by taking all positive steps and conclude the same as early as possible, preferably within six months after taking the same on priority basis.
