JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 22-06-2016 Learned counsel for the appellant submits that though the present appeal under proviso to Section 372 of the Code of Criminal Procedure against the judgment dated 5th November, 2015 passed in Sessions Trial No. 631 of 2009 by the learned Additional Sessions Judge, IV, Saran at Chapra would lie before the Division Bench, due to inadvertence the same has been filed as Criminal Appeal (Single Judge). In that view of the matter, he seeks leave to withdraw the present appeal in order to file an appropriate appeal before the Division Bench in the same subject matter.

Leave is granted.
